O refugiado como conceito-limite da política contemporânea na perspectiva Arendtiana do direito a ter direitos

The inability of States and international institutions to deal with the growing number of stateless persons and refugees, the greatest indicator since the Second World War, corroborates the need for analysis on this mass phenomenon. Therefore, the objective of this article is to examine the condition of these individuals in situations of extreme vulnerability, in light of the political theory of Hannah Arendt. If the 1789 Declaration of Human Rights seemed to have provided individuals with the necessary legal support, in fact the legal framework inherent in human rights has proved ineffective because it is still essentially related to the pre-existence of a nationality. The author points out that the contemporary novelty of forced migration is due to the fact that the impossibility of these persons finding a permanent home makes them not only outside of any legal scope, but also marginalizes them from humanity itself, which means that the removal of the rights, besides eliminating any type of legitimized belonging to some community, usually ends up condemning the individuals to the situation of barbarism. It is, therefore, guiding us through the Arendtian perspective on stateless persons and refugees, that the latter will be taken as the limiting concept from which contemporary politics can be understood because it is strongly inscribed in the fragility of concepts of State and of Law, as well as the degradation of the public sphere, corroborating with the right to have rights, that would be the guarantee of the man to belong to the own humanity. International relations.A incapacidade dos Estados e das instituições internacionais em lidar com o crescente número de apátridas e de refugiados, maior indicador desde a Segunda Grande Guerra, corrobora com a necessidade da análise sobre esse fenômeno de massa. Diante disso, o objetivo deste artigo é o exame sobre a condição desses indivíduos em situação de extrema vulnerabilidade, à luz da teoria política de Hannah Arendt. Se a Declaração dos Direitos do Homem de 1789 parecia ter assegurado aos indivíduos o respaldo jurídico necessário, na verdade o crivo legal inerente aos Direitos Humanos tem demonstrado pouca eficiência, por ainda estar essencialmente relacionado com a preexistência de uma nacionalidade. A autora assinala que a novidade contemporânea sobre as migrações forçadas se deve ao fato de que a impossibilidade destas pessoas encontrarem um lar definitivo os torna não apenas à margem de qualquer abrangência jurídica, mas também os marginaliza da própria humanidade, o que significa que a destituição dos direitos, além de eliminar qualquer tipo de pertencimento legitimado a alguma comunidade, geralmente acaba por condenar os indivíduos à situação de barbárie. Portanto, é através da perspectiva arendtiana sobre os apátridas e os refugiados que tomar-se-á os últimos como o conceito-limite a partir do qual se pode compreender a política contemporânea, por nele estar inscrita fortemente a fragilidade dos conceitos de Estado e de Direito, bem como a degradação da esfera pública, corroborando com o direito a ter direitos, que seria a garantia do homem de pertencer à própria humanidade.
