La naturaleza jurídica de los derechos intelectuales. Una perspectiva desde el derecho civil

Intellectual property is a discipline that combines a series of legal institutions that are coordinated and adapted in the framework of its study, interpretation and application; even so, its legal nature is heterogeneous and not free from theoretical discussions and debates, which have an impact on its practical application. In this regard, we will study the legal relationship between the provisions contained in our Civil Code and the special legislation (D. Leg. 822 – D. Leg. 1075 - Decision 486) on intellectual property law, in such a way that we approach the generic application of the same institution, referring to intellectual rights. Thus, we reflect on both regulations and their possibility of interpretation and application, avoiding that the norm tends to vacuum, opacity and systemic incoherence. Our study is not only perceived from the theoretical foundations, but it is important in the development of our subject matter and its application in our legal realityLa propiedad intelectual es una disciplina que conjuga una serie de instituciones jurídicas que se coordinan y adaptan en el marco de su estudio, interpretación y aplicación; aun así, su naturaleza jurídica es heterogénea y no libre de discusiones y debates teóricos, que terminan repercutiendo en su aplicación práctica. En este sentido, estudiaremos la relación jurídica entre las disposiciones contenidas en nuestro Código Civil y la legislación especial (D. Leg. 822 – D. Leg. 1075- Decisión 486), entorno al derecho de propiedad intelectual, de tal manera que, nos acerquemos a la aplicación genérica de una misma institución, referida a los derechos intelectuales. Así, reflexionamos sobre ambas normativas y su posibilidad de interpretación y aplicación única, evitando que la normativa tienda al vacío, la opacidad y la incoherencia sistémica. Nuestro estudio no solo se aprecia desde los fundamentos teóricos, sino que resulta importante en el desarrollo de nuestra materia y su aplicación en nuestra realidad jurídica.DOIhttps://doi.org/10.24265/voxjuris.2019.v37n2.0
