RISCO DE CONTAMINAÇÃO POR HIDROCARBONETOS NA COLÔMBIA

AbstractThe regulatory regimes of the risk of contamination by hydrocarbons are defined by Law No 1523 of 2012 and by the Decree 321 of 1999 “National Contingency Plan for Oil Spill”, however, we need to apply methodologies for interpretation. Our study aimed to characterize the regulatory regimes of the oil pollution risk in Colombia. The characterization was performed by a general description of the effects of oil pollution; we developed a spatial analysis of the events and was identified legislation that regulates oil activity in Colombia. Finally the characterization of regimes was done using arrays of analysis concerning the context and content of the system and the actors involved. The application of arrays allowed knowing that the type of risk is high; public opinion towards risk is divided and has a high organized interests. The regulatory regimes for this type of risk have proactive policies, contains a robust operational structure and interagency relationship high. The regulation of the risk of contamination by hydrocarbons is polarized by the particular interests of the industry and communities, and has not allowed a fair development that reduces the environmental impact and that will not endanger the sustainability of the country.Keywords: Oil Pollution, Risk, Regulation Regimes.ResumoOs regimes de regulação do risco de contaminação por hidrocarbonetos estão definidos através da Lei No 1523 de 2012 e no Decreto 321 de 1999 “Plano Nacional de Contingência contra Derrames de Hidrocarbonetos”, contudo, é preciso aplicar metodologias para a sua interpretação. Este estudo teve como objetivo caracterizar os regimes de regulação do risco de contaminação por hidrocarbonetos na Colômbia. A caracterização foi feita mediante a descrição geral dos efeitos da contaminação por hidrocarbonetos, foi desenvolvida uma análise espacial das ocorrências e foi identificada a legislação que regula a atividade petrolífera na Colômbia. Finalmente a caracterização dos regimes foi feita utilizando matrizes de análise relativas ao contexto e conteúdo do regime e aos atores envolvidos.A aplicação das matrizes permitiu conhecer que o tipo de risco é alto, a opinião pública face ao risco está dividida e expõe altos interesses de grupos organizados. Os regimes de regulação para este tipo de risco apresentam alta proatividade nas políticas, contem uma estrutura operativa robusta e o relacionamento interinstitucional é alto. A regulação do risco de contaminação por hidrocarbonetos está polarizada pelos interesses particulares do setor industrial e das comunidades e não têm permitido um desenvolvimento justo que reduza o impacto ambiental e que não prejudique a sustentabilidade do país.Palabras chave: Contaminação por Hidrocarbonetos, Risco, Regimes de Regulação
