The purpose of this article is to demonstrate that the interests at play in reforming systems of global justice work to the detriment of the emancipatory potential of the liberal state, and consequently to the constitutional guarantees protecting minorities by judicial decree. Recent attempts at legal reform in Colombia, although conducted before the legislature, illustrate this phenomenon.
