Analysis of Contract on Poultry Partnership: Review of Alleged Monopoly Practice and Unfair Business Competition

The requirement of investing in poultry industry can be facilitated in various ways. Partnership system became the most popular choice by investors, both by large integrated businessmen and farmers. This study aimed to assess whether contract on poultry partnership has been appropriate or not in accordance with the principles of healthy business competition. The purpose of this research was to determine alleged violations of fair business was done on contract of poultry partnership. \ud Population of this research was poultry partnership which have carried out in several provinces in Indonesia. Geographically, the province was chosen by cluster sampling. It was selected two (2) provinces, namely East Java and South Sulawesi. Random sampling was then conducted and selected three (3) poultry partnerships for each province.\ud This study found a number of contract on poultry partnerships were still against the principle of healthy competition and monopoly practice. But there were also a number of contracts that did not violate the principle of fair competition and practice monopoly. Violations of healthy business competition and monopoly practices was mostly done on the system due to closed agreement was done by the parties which applied to farmers.
