IMPACTO DE LAS REFORMAS ECONÓMICAS NEOLIBERALES EN COLOMBIA DESDE 1990

The restructuring is a legal financial figure by which it seeks to transform, specialize, expand services, consolidate and rescue financial insti­tutions that are in difficulties within the sector. To help you get the restructuring, the company must always have the approval of the Financial Superintendence of Colombia, overseer, contro­lling entity that will be responsible for giving the authorization, to join in the process if required, and may even work as a financial advice entity if institutions require it and / or request it.The article comes from the research project en­titled: THE CONCEPT OF VALUE AND ITS IMPACT ON SECURITIZATION, project approved by the Research Center of Universidad Autonoma de las Americas, which has been working for almost five months, with the Group Ratio Juris, attached to Colciencias .In Colombia, we have many years developing of this kind of transformation, but the first that came to reality, were supported in the existing standard for the real sector, and the results were not good, also because some of these restructurings were made regardless the actual state of the financial institutions. We could conclude that there were many improvisations.Since the issuance of Decree 663 of 1993 (Orga­nic Statute of the Financial System), the way of restructuring in Colombia has improved, given that the new rules are specific for the sector, and in that they identify the kinds of restructuring arranged for financial institutions, including: acquisition, merger, conversion, and transfer of assets, liabilities and contracts.In the last five years in the financial sector is showing significant movements through restructuring, especially in conversions, and of course many more are expected. This means that financial institutions are in constant search of new financial strategies, accommodations, and so on. This shows that ac­tivity in the sector due not only to the demands of a globalized industry and competitive zeal, but also driven by the growth of financial customers or users, as a response to the constant search for a thicker underground, between some other considerable issues.Colombia en las últimas décadas ha venido im­plementando reformas de todo tipo (políticas, económicas y sociales) encaminadas al supuesto fortalecimiento económico para poderla encla­var dentro de un contexto internacional. Estas reformas han dejado resultados insatisfactorios y conflictos más profundos por la polarización de las ideas de la subsistencia del más fuerte, a la usanza de la selva.Las reformas realizadas por el gobierno preten­dieron seguir un orden mundial establecido, en donde todo el peso del desarrollo económico se deja al criterio mercantil y en donde, por lo tanto, lo que menos justifica preocupaciones es el ámbito de lo social. Con estas reformas susci­tadas durante la administración del Presidente Virgilio Barco, (1986-1990), profundizadas en el gobierno de César Gaviria (1990-1994), y seguidas por los subsiguientes mandatarios hasta hoy, es que se comenzó a evidenciar la poda de bienes y funcionarios públicos, ya sea por la privatización de entidades públicas, que ahora se dejaban al criterio de transnacionales, o por la aplicación de programas de ajuste fiscal que pretenden aniquilar el Estado para darle paso a políticas comerciales impuestas.La Colombie dans dernières décennies a met en application des réformes de toute espèce (politiques, économiques et sociales) dirigées vers le raffermissement supposé économique pour pouvoir la clouer à l’intérieur d’un contexte international. Ces réformes ont laissé des résul­tats insatisfaisants et des conflits plus profonds par la polarisation des idées de la subsistance du plus fort, à l’usage de la forêt.Les réformes réalisées par le gouvernement ont essayé de suivre un ordre mondial établi, où tout le poids du développement économique se fait au critère mercantile et où, par conséquent, ce qui justifie moins des préoccupations est le do­maine du social. Avec ces réformes suscitées du­rant l’administration du Président Virgilio Barco, (1986-1990), approfondies dans le gouvernement de César Gaviria (1990-1994), et suivies par les mandataires subséquents jusqu’à un aujourd’hui, c’est que l’on a commencé à mettre en évidence la taille de biens et les fonctionnaires publics, consistez déjà par la privatisation d’entités pu­bliques, en ce que maintenant ils se faisaient au critère de transnationaux, ou par l’application de programmes d’ajustement fiscal qui essaient d’annihiler l’État pour lui donner un pas à poli­tiques commerciales imposées
