The definition of a refugee contained in the Canadian Immigration Act requires that refugee claimants establish a well-founded fear of persecution based on one of the enumerated grounds, namely race, religion, nationality, membership in a particular social group or political opinion. As sex is not enumerated, many women must establish their claim on the basis of membership in a particular social group. The standard of internal cohesion that the courts employed in defining a particular social group severely restricted the grounds available to women claiming refugee status.
