La constitución como orden de valores. Reflexiones en torno al neoconstitucionalismo

This article intends to show how Neoconstitutionalism responds to the development of a constitutional theory and practice, both of which are progressively convergent. Such development has played an important role on the decisions of the German Federal Constitutional Court and on the science of public law in Germany. Such development is born from the adoption of the Constitution as an order of values. Definitely, it is no other thing than a transformation occurred due to the adoption of a theory about what the Constitution is: an order of values, where the structural elements of the State obey to principles which are also found in the basis of the fundamental rights system. What is new and capital about this form of constitutionalism are the material and substantial qualities of the Constitution which make it practically omnipresent in every creative operation and application of law.El presente artículo pretende mostrar cómo el neoconstitucionalismo se corresponde con el desarrollo de una teoría y una praxis constitucionales progresivamente convergentes, en el cual han desempeñado un importante papel la jurisprudencia del Tribunal Constitucional Federal alemán y la ciencia del Derecho público alemana, y que nace de la adopción de una concepción de la Constitución como orden valorativo. En definitiva, no es otra cosa que una transformación operada como consecuencia de la adopción de una teoría acerca de lo que la Constitución es: un orden valorativo donde los elementos estructurales del Estado obedecen a principios sustantivos que se hallan también en la base del sistema de los derechos fundamentales. Lo decisivo y novedoso de este constitucionalismo radica, precisamente, en las cualidades materiales o sustanciales de la Constitución, que la tornan prácticamente omnipresente en toda operación de creación y aplicación del Derecho
