PERTANGGUNGJAWABAN PIDANA KORPORASI KEPADA KORBAN TINDAK PIDANA

This paper intends to review and recognize the criminal liability of corporations to victims of crime in Indonesia's current positive law, the application of sanctions against corporations in accordance with Indonesian legislation in an effort to provide protection against victims of crime, as well as corporate criminal liability to victims of crimes in the future come.The result of the research shows that the criminal responsibility system adopted in accordance with the provisions of Indonesian positive criminal law is more inclined to the doctrine of identification theory and the doctrine of delegation. In addition to looking at where the errors of the makers are also concerned with from where the source of acting authority is owned. However, when viewed in a comprehensive manner, between the provisions in criminal law that one with the other criminal law also varies. For example, about the perpetrator, where the person committing the crime does not have to be an administrator but anyone who is in the name or does so for the benefit of the company.The application of sanctions against corporations according to the laws and regulations, the authors have concluded that the sanctions that can be imposed on the corporation in an effort to provide protection against victims of crime are: 1) Criminal penalties include a fine of fines. 2) Additional criminal and 3) Action Sanctions. Corporate criminal liability for corporations in the future is expected to be more uniform and consistent in terms of determining when a crime is said to be a corporate crime, who can be prosecuted and sentenced in a corporate crime, and what kind of sanction is appropriate for the corporation who commit a crime, especially in order to provide the fulfillment and restoration of the rights of victims for crimes committed by corporations, and in order to prevent and combat corporate crime itself.Keywords: Criminal Liability, Corporate, Criminal Act
