A CONSTRUÇÃO DO DIÁLOGO E DA SOLIDARIEDADE E A PROTEÇÃO DO BEM AMBIENTAL E DA NATUREZA NA CONCEPÇÃO UNIVERSAL DO HUMANO, A PARTIR DE UMA LEITURA DA ENCÍCLICA LAUDATO SI

From the reading of the Papal Encyclical Laudato Si has aimed to demonstrate that the human relationship with the environment is inseparable assumption of the universal concept of human rights. Therefore, to use as a methodology, the research of the principles of environmental law and dichotomous discussion between anthropocentrism and biocentrism, in order to determine the limits (and actually there) solidarity and fraternity, as rights-guarantees for an effective and essential protection of the ecologically balanced environment and a healthy quality of life for present and future generations. At this point, it has been collate methodology and reference the principles of environmental law, especially the principle of an ecologically balanced environment and sustainable development, beginning the cosmopolitan vision of human rights from the design of multigenerational rights, in order to show the objective of this article, there is real relationship between environmental protection and development and meeting the spiritual being (this is not in the religious sense, but of existential quest for dignified life or abundance) and protection of fundamental rights, regardless of biocentric or anthropocentric view that wants to provide the environmental law.A partir da leitura da Encíclica Papal Laudato Si, este estudo objetiva demonstrar que a relação do humano com o meio ambiente é pressuposto indissociável da concepção universal dos direitos humanos. Para tanto, utiliza-se como metodologia a pesquisa dos princípios do Direito Ambiental e da discussão dicotômica entre antropocentrismo e biocentrismo, com o objetivo de apurar os limites (e se realmente os há) da solidariedade e fraternidade, como direitos-garantias para uma proteção efetiva e primordial do meio ambiente ecologicamente equilibrado e da sadia qualidade de vida para as presentes e as futuras gerações. Nessa perspectiva, tem-se como metodologia cotejar e referenciar os princípios do Direito Ambiental, especialmente o princípio do meio ambiente ecologicamente equilibrado e do desenvolvimento sustentável, principiando a visão cosmopolita dos direitos humanos a partir da concepção de direitos multigeracionais, com o intuito de demonstrar que existe verdadeira relação entre a proteção do meio ambiente e o desenvolvimento e encontro do ser espiritual (este não na acepção religiosa do termo, mas na acepção de busca existencial pela vida digna ou em abundância) e da proteção dos direitos fundamentais, independentemente da visão biocêntrica ou antropocêntrica que se queira fornecer ao Direito Ambiental
