Justiça Restaurativa: A cura pelo perdão

The research seeks to analyze the phenomenon of crime in your vision, and the proposal of retributive restorative justice as a new ideal of Justice, which is to complement the current system, through a participatory and collaborative process. Restorative justice proposes a change of focus, the materiality of the offence to the people involved and the restoration of ties broken, where through dialogue the parties may expose your feelings about the conflict. Finally, in this perspective, it is intended that the parties allow get to repentance and forgiveness, the repair of the damage and the conscious of the offender accountability. The study of this subject's importance to the Brazilian justice, as well as the society, for addressing a new look on the crime, the involvement of all people who are interested in the conflict-directly and indirectly-on the restoration of broken links and the construction of a State of social peace.O trabalho ora exposto associa-se à linha de pesquisa Políticas de Cidadania e Resolução de Conflitos, vinculada ao Programa de Pós-Graduação Stricto Sensu em Direito - Mestrado URI (Campus de Santo Ângelo). Em primeiro lugar, os dados da pesquisa, cujos resultados iniciais encontram-se no presente artigo, tiveram por parâmetro investigativo o método hipotético-dedutivo, a pesquisa bibliográfica e, ao mesmo tempo, adotaram as experiências profissionais dos autores do texto. A pesquisa busca analisar o fenômeno do crime na sua visão retributiva, e a proposta da Justiça Restaurativa como um novo ideal de justiça, que vem a complementar o sistema atual, por meio de um processo participativo e colaborativo. A Justiça Restaurativa propõe uma mudança de foco, da materialidade do delito às pessoas envolvidas e a restauração dos laços rompidos, onde, por intermédio do diálogo, as partes possam expor seus sentimentos em relação ao conflito. Por fim, nessa perspectiva, pretende-se que as partes se permitam chegar ao arrependimento e ao perdão, à reparação do dano e à consciente responsabilização do ofensor. O estudo dessa temática tem importância à justiça brasileira, bem como a toda sociedade, por abordar um novo olhar sobre o crime, o envolvimento de todas as pessoas que sejam interessadas no conflito - direta e indiretamente - na restauração dos laços rompidos e na construção de um estado de paz social
