PEMBAYARAN DENGAN GIRO DALAM TRANSAKSI JUAL BELI DI PASAR SANDANG TEGALGUBUG CIREBONDALAM PERSPEKTIF HUKUM EKONOMI SYARI’AH

ABSTRACTIslam has determined the rules of law, whether on terms, principles or other forms of sale and purchase which are not allowed. Therefore, in practice must be in accordance with the terms and principles. But sometimes in the practice of buying and selling there is a deviation from the rule of law. Payment of demand deposits on sale and purchase transactions in the clothing market Tegalgubug Cirebon, conducted by deceiving the seller by exploiting sellers ignorance and not pay off liabilities in the payment of sale and purchase. Based on the phenomenon, the author intends to analyze from the point of view of sharia economic law?The type of research used in this study is descriptive qualitative research that aims to provide an overview of the object of research clothing market Tegalgubug. The results of this study that the sale and purchase of demand deposits in the clothing market Tegalgubug contrary to sharia economic law because in practice not balanced with the honesty by the buyer against the seller. Due to the payment of demand deposits, there is uncertainty about the outstanding balance and the maturity of the loan disbursement. It certainly can harm both the sellers and other communities.Keywords:Giro payment, Purchas.ABSTRAK Islam telah menentukan aturan-aturan hukum, baik mengenai syarat, rukun maupun bentuk jual beli yang tidak diperbolehkan. Oleh karena itu dalam prakteknya harus sesuai dengan syarat dan rukunnya. Tetapiadakalanya dalam praktek jual beli terdapat penyimpangan dari aturan hukum. Pembayaran giro pada transaksi jual beli di pasar sandang Tegalgubug Cirebon, dilakukan dengan menipu pihak penjual dengan memanfaatkan ketidaktahuan penjual dan tidak melunasi kewajiban dalam pembayaran jual beli. Berdasarkan fenomena tersebut, penulis bermaksud menganalisis dari sudut pandang hukum ekonomi syari’ah?Adapun jenis penelitian yang digunakan dalam penelitian ini adalah penelitian kualitatif deskriptif yang bertujuan untuk memberikan gambaran mengenai objek penelitian yakni pasar sandang Tegalgubug. Hasil dari penelitian ini bahwa jual beli pembayaran giro di pasar sandang Tegalgubug bertentangan dengan hukum ekonomi syari’ah karena dalam prakteknya tidak diimbangi dengan kejujuran oleh pihak pembeli terhadap penjual. Karena pembayaran giro terdapat ketidakjelasan terhadap saldo yang tertera dan tidak jelas jatuh tempo pencairannya. Hal tersebut tentunya dapat merugikan baik pihak penjual maupun masyarakat lainnya.Kata kunci : Pembayaran giro,Jual Beli
