KEDUDUKAN WARIS ANAK DI LUAR NIKAH (STUDI KOMPARASI ANTARA PUTUSAN MAHKAMAH KONSTITUSI DENGAN FATWA MAJELIS ULAMA INDONESIA)

ABSTRACT Though records of marriage are not including that determine the validity of a marriage in Islam, but its application in Indonesia tercatatkan not lead to marriage not recorded also in State law. Until then the Constitutional Court issued a ruling that accommodate the status of all children. This poses a serious problem among the Assembly of scholars of Indonesia.The problem of the research is how the position of heir child outside of marriage according to the Constitutional Court (MK), How is the position of heir child outside of marriage according to the Assembly of Indonesia Ulema (MUI), What about the similarities and differences of the position of heir child outside of marriage according to the Constitutional Court by the Assembly of scholars of Indonesia.According to the study, this study was conducted with library research (library research) while the analytical technique is to find and analyze primary and secondary references.Keywords: Inheritance, Children outside of marriage, the ruling of the Constitutional Court, and by the Permanent Assembly of Indonesia Cleric. ABSTRAK Sekalipun mencatatkan perkawinan bukanlah termasuk yang menentukan keabsahan suatu perkawinan dalam Islam, namun dalam aplikasinya di Indonesia perkawinan yang tidak tercatatkan menyebabkan anak tidak tercatat juga secara hukum negara. Sampai kemudian Mahkamah Konstitusi mengeluarkan putusan yang mengakomodir status semua anak. Hal ini menimbulkan problem serius di kalangan Majelis Ulama Indonesia.Masalah penelitian ini adalah bagaimana kedudukan waris anak di luar nikah menurut putusan Mahkamah Konstitusi (MK), bagaimana kedudukan waris anak di luar nikah menurut fatwa Majelis Ulama Indonesia (MUI), bagaimana persamaan dan perbedaan kedudukan waris anak di luar nikah menurut putusan Mahkamah Konstitusi dengan fatwa Majelis Ulama Indonesia.Sesuai kajian, maka penelitian ini dilakukan dengan studi kepustakaan (library research) sedangkan teknik analisisnya yaitu dengan mencari dan menganalisis referensi-referensi primer dan sekunder.Kata Kunci: Waris, Anak di Luar Nikah, Putusan Mahkamah Konstitusi, dan Fatwa Majelis Ulama Indonesia
