Chief justice shahabuddin Ahmed was made Head of provisional caretaker government after the fall of military dictator Ershad in 1990 while he was in active service. Justice Shahabuddin Ahmed was the common choice of the political parties though this selection contravened the constitution. After arranging nationally and internationally acclaimed free and fair election in February, 1991 Shahabuddin Ahmed, Acting President, expressed his desire for going back to active judicial service.
