PEMBENTUKAN HOLDING COMPANY BUMN DALAM PERSPEKTIF HUKUM PERSAINGAN USAHA

In light of the contribution from state-owned companies that fairly need to be improved, to increase and to greatly empower several sectors in those state-owned companies, restructuring should be accommodated. Thus, restructuring state-owned companies by establishing holding company for each sector has been planned by the government, which is Ministry of State-Owned Company. The goal of early idea from restructuring and establishing state-owned holding companies is to optimize their management. However, while the main goal is to gradually intensify its management and profit, government plan to restructuring state-owned company has to face several constraints, one of them related to anti-competition law. There is indication that holding companies established by the government is in collide with trust arrangement that violate Law Number 5 Year 1999
