Limitación de funciones parentales para la salvaguarda del menor en situaciones de violencia de género

Gender violence is a trending topic in Spanish Law. The normative development carried out in recent years in our country shows a positive evolution on this subject. The initial approach always went from protection to women, but it begins to be taken into account that the child must also be protected in cases of gender violence. These minors, although they have been able to not be mistreated directly, suffer the psychological consequences of the episodes of abuse towards their mothers. It is necessary to address the situation of the child with completeness, since the relations between the parents will be tense in these cases and surely there have been established precautionary measures that prevent the communication between the parents. The child, therefore, will be directly affected by the problems related to their parents. It is highly discussed and delicate to assess what measures can be applied in situations where domestic violence against the child is not exercised, but gender violence in which the child may be affected by emotional abuse within the family environment. The existence of a right to communicate and relate to the father should also be weighted with the interest of the child, taking into account that the exercise of the same could, in some cases, endanger the safety of the child and the mother. El desarrollo normativo realizado en los últimos años en nuestro país muestra una evolución en positivo sobre esta materia. El planteamiento inicial siempre partió de la protección a la mujer, pero empieza a tenerse en cuenta que también hay que proteger al menor en los casos de violencia de género. Estos menores, si bien han podido no ser maltratados directamente, sufren las consecuencias psicológicas de los episodios de maltrato hacia sus madres. Es necesario abordar la situación del menor con exhaustividad, pues las relaciones entre los progenitores serán tensas en estos casos y seguramente habrán sido establecidas medidas cautelares que impiden la comunicación entre los padres. El menor, por ello, se verá afectado directamente por la problemática relacionada con sus progenitores. Es muy discutido y delicado valorar qué medidas se pueden aplicar en situaciones donde no se ejerce violencia doméstica contra el menor, pero sí violencia de género en la que el menor se puede ver afectado por maltrato emocional dentro del ámbito familiar. Igualmente habrá que ponderar con el interés del menor la existencia de un derecho de comunicar y relacionar con el padre, teniendo en cuenta que el ejercicio del mismo podría, en algunos casos, poner en peligro la seguridad del hijo y de la madre.
