Casarse, mandar y obedecer en el Virreinato del Río de la Plata: un estudio del deber-derecho de obediencia a través de los pleitos entre cónyuges

The aim of this article is to analyze the obligation of `obedience´ between husbands and wives in the Virreinato del Río de la Plata (1776-1810). The main sources are the lawsuits between spouses on file at the Archivo General de la Nación and the Archivo Histórico de la Provincia de Buenos Aires, both in Argentina, as well as the applicable legislation and the opinions of legal and moral doctrine. Through the analysis of these lawsuits we will attempt to determine the effective fulfillment, or non-fulfillment, of the norms prescribed for husbands and wives, with a goal of understanding whether they were felt to have been reasonable, and any adjustments people may have made between the norms and their lived realities. The purpose of this article is to establish a link between legal and social history. In this way, the article aims to portray, through the lawsuit, the permeability of the Colonial society to the New Ideas of the eighteenth century, and the acceptance, or non-acceptance, of new convictions about cohabitation, the decrease of marital authority, and the notion of individualism.El presente trabajo analiza el deber de obediencia entre cónyuges en el período correspondiente al Virreinato del Río de la Plata (1776-1810), tomando como fuente principal los expedientes judiciales que se conservan en el Archivo General de la Nación (Argentina) y el Archivo Histórico de la Provincia de Buenos Aires, así como la legislación aplicable en la época y la opinión que sobre el tema tenía la doctrina moral y jurídica. A partir de pleitos entre cónyuges, se tratará de ver el cumplimiento efectivo, o el apartamiento de las normas culturales y jurídicas impuestas a marido y mujer. Este trabajo tiende un puente entre la historia del derecho y la historia social y pretende ver, a través del litigio, la permeabilidad de la sociedad colonial al avance de las nuevas concepciones del siglo XVIII, y la aceptación o no de nuevas pautas acerca de la flexibilidad de la convivencia, la disminución de la autoridad marital y el individualismo
