ABSTRACT - Enactment of Indonesian Decree No 103 2015 regarding ownership of land or property and or house occupancy by foreigner who stay in Indonesia, enable them to own house or residence in Indonesia which is limited to usage rights. Based on juridical point of view of Indonesian law, foreigners are able to make testament for their beneficiary upon their rights including usage rights of house or residence. The present study aims to elaborate further about legal protection of foreigner who holds usage right of house or residence in Indonesia coupled with legal consequences of the beneficiary concerning the testament that is given by the foreigner.
