La Convención de Viena sobre Compraventa Internacional de Mercaderías y la función social del contrato en el derecho brasilero

The increase of trade relations in recent years, is one of the reasons why the use of contracts as a means to express the will of the parties the most common parts around has become increasingly common. Faced with this move change, the Brazilian State was the need forced to establish parameters able to preserve and limit the social impact that these relationships occur in the would cause in the community society. To this end, certain principles were laid down in the Constitution and other legislative bodies; within these we find in particular is the principle of ‘social function of contract’. Considering the increase in international business transactions and the recent accession of Brazil to the ViennaConvention on Contracts for the International Sale of Goods International Sale and Purchase of Goods–a widely uniform law governing such contracts and is based on purely commercial principles and international principles– it is necessary to analyze the constitutional aforementioned principle mentioned, considering the new business scenario in which it will act apply.El incremento de las relaciones comerciales durante los últimos años es una de las razones por las cuales la utilización de los contratos como medio para expresar la voluntad de las partes se ha tornado cada vez más frecuente. Ante este cambio, el Estado brasilero se vio en la necesidad de establecer parámetros capaces de preservar y limitar los efectos sociales que estas relaciones producirían en la comunidad. Con este fin, determinados principios fueron establecidos en la Constitución y en otros cuerpos legislativos, dentro de los cuales destaca el principio de la función social del contrato. Teniendo en consideración el incremento de las transacciones comerciales internacionales y la reciente adhesión de Brasil a la Convención de Viena sobre Compraventa Internacional de Mercaderías –ley uniforme que regula ampliamente este tipo de contratos y se sustenta en principios netamente comerciales e internacionales–, resulta necesario analizar el principio constitucional mencionado, considerando el nuevo escenario comercial en el que actuará
