Los derechos de la víctima del delito en la ley 906 de 2004: Análisis de su reconocimiento y evolución jurisprudencial

The present article analyzes the rights of crime victims from the new accusatory penal system that was implemented in Colombia through Law 906 of 2004, consider, first, if this legal system of judgment establishes clear and effective substantial and procedural guarantees for the victims, and second, if these safeguards are compatible with the principles set out in the field of human and fundamental rights, scientific inquiry that generally corresponds to a qualitative research and some specific aspects of a quantitative research, and in which we identified the legal void visible on the rights of victims meant the implementation of the legal system analyzed, since, although the ordinance includes multiple rights, is latent limiting participation and lack of mechanisms to realize these protections, a deficiency that has been progressive but not fully remedied by the jurisprudence of the Constitutional Court, in particular through of C-454-2006, C-209-2007 and C-516- 2007 decisions, and in which it was restored to a regulatory framework consistent with the principles established in human rights and fundamental guarantees.El presente artículo analiza los derechos de la víctima del delito a partir del Nuevo Sistema Penal Acusatorio que se implementó en Colombia por medio de la Ley 906 de 2004, examinando, en primer lugar, si dicho sistema jurídico de enjuiciamiento establece claras y eficaces garantías sustanciales y procesales para las víctimas, y segundo, si dichas salvaguardas resultan compatibles con los principios dispuestos en materia de derechos humanos y fundamentales, indagación científica que de manera general corresponde a una investigación de tipo cualitativa y en algunos aspectos específicos a una investigación de tipo cuantitativa, y en la que se logró identificar el visible vacío jurídico que en materia de derechos de las víctimas significó la implementación del sistema jurídico analizado, toda vez que, si bien dicho ordenamiento incluyó múltiples derechos, es latente la limitación de participación y la falta de mecanismos idóneos para materializar dichos amparos, deficiencia que ha sido progresiva más no totalmente subsanada por la jurisprudencia de la Corte Constitucional, en especial por medio de las sentencias C-454 de 2006, C-209 de 2007 y C-516 de 2007 en las que se logró restablecer un marco normativo coherente con los principios establecidos en derechos humanos y garantías fundamentales
