Pueblos indígenas: Defensa de sus imaginarios e identidades culturales en la disputa por el territorio

The department of Cauca is recognized for being a territory with a high presence of ethnic communities, both indigenous and Afro-Colombian. It is also a territory that has different internal and intercommunity conflicts that are motivated by access to land and by the territorial government that involves both local farmers, Afro-Colombians and indigenous. This document will evaluate the legal explanation of these conflicts, which fall mainly on the assignment that INCODER as an administrative authority has given to the territories of the Department, and in response to this complaint, has strongly embarked to vindicate the traditions and customs that upon these territories a construction of imaginaries and identities of these communities has been built. This argument that worked mainly for the indigenous communities, who counts on important pieces of jurisprudence which has recognized the cultural link between these communities and the territory, by appealing, among other things, to international rules in defense of the traditions, customs and identity of indigenous communities that founds their sense of autonomy.El departamento del Cauca se reconoce por ser un territorio con una alta presencia de comunidades étnicas, tanto indígenas como afrocolombianas. Igualmente, es un territorio que presenta diferentes conflictos intra e intercomunitarios motivados por el acceso a la tierra y por el gobierno territorial que involucra tanto a campesinos de la región, afrocolombianos e indígenas. En el presente documento, se evalúa la explicación jurídica de estos conflictos que recaen principalmente en la asignación que ha dado el INCODER como autoridad administrativa a territorios del Departamento, y que como respuesta, en su reclamación se ha abocado fuertemente a revindicar las tradiciones y costumbres que sobre estos territorios erigen la construcción de imaginarios e identidades de estas comunidades, argumento que ha servido en mayor medida a las comunidades indígenas, quienes cuentan con un acervo jurisprudencial que ha sabido reconocer el vínculo cultural de estas comunidades con el territorio, apelando entre otras cosas a las disposiciones internacionales en defensa de las tradiciones, costumbres e identidades de las comunidades indígenas que fundan el sentido de su autonomí
