Tratamiento jurídico al terrorismo para la guerrilla colombiana FARC- en el marco de la justicia transicional

This article is the result of a theoretical investigation that conduces the author to the Title of Master in Studies of Terrorism aimed to determinate the postulated true Peace Agreement against an eminently politician agreement seeking for a negotiated end to a Violent conflict where actors who use violence pretending a monopolization, dialogue with the States to allow their participation in the exercise of political power.However, during the violent periods in Colombia, crimes and social reprehensible conducts have been committed not only from the inner normativity but also from the international regulations where Terrorism has been described as an 'atrocious crime' that has a connection to the political crime which would prevent the political Participation of the subversive group.From the deductive methodology with a critical analytical approach and through the historical-hermeneutical method, it was able to see the possible consequences from the legal system of both international and national, and the pronouncements of the Constitutional Court which since the validity of the Constitution of 1991, it occurred in the terrorism line allowing to conclude that the legal treatment of terrorism in the context of transitional justice obeys a sui generis form where there is no relationship with the political crime but their benefits do apply to the authors of this crime.El presente artículo es producto de una investigación teórica que condujo al título de Master en Estudios sobre Terrorismo, tendiente a determinar los verdaderos postulados de Paz frente a un acuerdo eminentemente político que busca una salida negociada a un conflicto violento por cuanto, los actores que utilizan la violencia con pretensión de monopolización, dialogan con los Estados a fin de propender su participación en el ejercicio del poder político.No obstante, durante los periodos violentos en Colombia, se han cometido delitos y conductas socialmente reprochables no únicamente desde el punto de vista de la normatividad interna sino también la internacional donde al terrorismo se le ha calificado como un 'delito atroz' que no tiene conexidad con el delito político, lo que impediría la participación en política del grupo subversivo.Desde la metodología deductiva con un enfoque crítico analítico y a través del método histórico-hermenéutico, se vislumbró las posibles consecuencias desde el ordenamiento jurídico tanto nacional como internacional y los pronunciamientos de la Corte Constitucional que desde la vigencia de la Carta Política de 1991 se dieron en materia de terrorismo permitiendo concluir que el tratamiento jurídico al terrorismo en el marco de una justiciatransicional obedece a una forma sui generis donde no existe relación con el delito político pero sus beneficios sí le son aplicables a los autores de este delito
