PERLINDUNGAN HUKUM TERHADAP ANAK DIBAWAH UMUR KORBAN TINDAK PIDANA PENCABULAN

The Cases of child sexual abuses are continues to increase over time. Children are the nation’s future generation who need special legal protection which is different from adults, because of their immaturity physical and mental reasons. The legal protection of children is defined as the legal protection to the children’s freedom and rights which is related to the welfare. Espiacially the protection of minors, victims are those who suffer physically and spiritually as a result of the actions of other people seeking fulfillment of themselves or others in opposition to suffering interests and rights.Protection of victims van over forms of protection that are indirect or direc, children really need to be protected from varios forms of crime. Legal efforts in child protection are rehabilitation efforts, protection efforts on the identity of public victims, efforts to provide guarantees of safety against victims. Efforts to choldren must be given as a whole thoroughly and comprehensively not in favor of one group of group of children.Factors of legal protection efforts for underage children can be seen from those that influence the environment, media factors, psychology factors, educational factors, and family factors so the goverment must pay attention to cases that occur in minors.Key words: legal protection,child victim,criminal offense Kasus pencabulan terhadap anak terus meningkat dari waktu ke waktu. Anak merupakan generasi penerus bangsa yang membutuhkan perlindungan hukum khusus yang berbeda dengan orang dewasa, dikarenakan alasan fisik dan mental anak yang belum dewasa dan matang. Perlindungan hukum anak diartikan sebagai upaya perlindungan hukum terhadap kebebasan dan hak asasi anak yang berhubungan dengan kesejahteraan, khususnya perlindungan anak dibawah umur korban adalah mereka yang menderita jasmaniah dan rohaniah sebagai akibat tindakan orang lain mencari pemenuhan diri sendiri atau orang lain bertentangan dengan kepentingan dan hak asasi yang menderita.Perlindungan korban dapat mencangkup bentuk perlindungan yang bersifat tidak langsung maupun langsung, anak sangat perlu dilindungi dari berbegai bentuk kejahatan. Upaya hukum dalam perlindungan anak, upaya rehabilitas, upaya perlindungan pada identitas korban publik, upaya pemberian jaminan keselamatan terhadap korban. Upaya terhadap anak harus diberikan secara utuh menyeluruh dan komprehensif, tidak memihak kepada satu golongan atau kelompok anak.Faktor-faktor dari upaya perlindungan hukum terhadap anak dibawah umur bisa dilihat dari faktor yang sangat mempengaruhi ialah faktor lingukan disekitar, faktor media, faktor psikologis, faktor pendidikan dan faktor keluarga. Jadi pemerintah harus memperhatikan gejala kasus yang terjadi pada anak dibawah umur.Kata kunci: perlindungan hukum, korban anak,pencabula
