ANALISIS YURIDIS TERHADAP KEBIJAKAN PRIVATISASI BUMN PADA SEKTOR PERTAMBANGAN DI INDONESIA

Privatization of BUMN is one of the most controversial issues in the Indonesian economy. On the one hand, privatization is still recognized as necessary to help close the APBN financing gap, on the other hand resistance arises here and there so that the Ministry of BUMN is difficult to realize it. In the mining sector, privatization was carried out on three state-owned companies, namely from PT Timah Tbk (TINS), PT Aneka Tambang Tbk (ANTM) and PT Bukit Asam Tbk (PTBA). The transfer of state-owned shares in the three companies to PT Indonesia Asahan Alumunium (Inalum) will become the holding of the BUMN Mine. With the policy of privatization of SOEs in the mining sector towards the three companies with the BUMN Holding system, of course it is contrary to Article 74 paragraph (2) of Law Number 19 of 2003 concerning SOEs. The privatization policy of the State-Owned Enterprises (BUMN) in the mining sector in Indonesia is carried out by the BUMN holding method. This method is carried out by increasing the State capital participation of the Republic of Indonesia into the share capital of the PT Indonesia Asahan Aluminum company. This method is carried out on all Series B shares owned by the Republic of Indonesia of the Company (Persero) PT Aneka Tambang Tbk, PT Bukit Asam Tbk (Persero), and PT Timah Tbk.Keywords: Privatization, Mining, and BUMN Holding
