The jurisprudence of prostitution in Canada suggests laws surrounding the practice have to date created dangerous conditions for women who engage, whether by choice or necessity, in prostitution. In light of the recent precedent-setting Bedford v. Canada, which demonstrated the unconstitutionality of Canada’s prostitution laws and the recent introduction of Bill C-36, this article examines the preconceived notions behind sex work, and concerns about morality and safety that pervade current prostitution law. An analysis of selected jurisdictions considers the implications of the legalization and/or decriminalization of prostitution.
