Worker’s rights, incidence in the right of privacy

RESUMEN: El presente trabajo tiene como objetivo el estudio de un derecho fundamental, como es el derecho a la intimidad (art.18.1 CE) de los trabajadores y su protección frente a posibles vulneraciones por parte del empleador en virtud de su poder de dirección y control (art. 20.3 ET). Analizando cada uno de estos derechos con el objetivo de determinar cuál es el alcance y límites de estos derechos en el ámbito laboral. Debiendo también tener en cuenta el derecho a la protección de datos (art. 18.3 CE) el cual se puede ver vulnerado por los controles que el empleador realice sobre los dispositivos digitales de la empresa que usen los trabajadores, siendo por ello importante analizar la nueva ley 3/2018, de 5 de diciembre, LOPD. Centrándome en dos supuestos concretos que habitualmente pueden llegar a producir una posible vulneración del derecho a la intimidad de los trabajadores, como es la intervención por parte del empleador del correo electrónico y la instalación de sistemas de videovigilancia en la empresa. Siendo para ello imprescindible el estudio de la doctrina establecida a lo largo de los años por el TC y los recientes pronunciamientos del TEDH.ABSTRACT: The objective of the present dissertation is the study of a fundamental right, specifically the workers’ right to privacy (art. 18.1 CE) and their protection from possible violations by the employer caused by their power of direction and control (art. 20.3 ET). Each of those rights will be analysed with the objective of determining what the scope and the limits in the business environment are. The right to data protection (art. 18.3 CE) will be taken into account, which can be violated by the controls that the employer may carry out through the company’s digital devices, being thus the análisis of the new law 3/2018 of 5º of December (LOPD) important. We will focus on two assumptions that can suppose a posible violation of the right to privacy, such as the email intervention made by the employer and the CCTV installation in the company. Consequently, the study of the established doctrine through the years by the Constitucional Court and the recent ECHR’s pronouncementes are essential.Grado en Derech
