Legal Writing explains the responsibility of an insurance company as a guarantor of the insured due to a motor vehicle accident that harms third parties. Aim to find out how the responsibility of the insurance company as the insurer carried out by PT. Asuransi Bintang Malang City and the process of settling claims against the insured is detrimental to third parties. The research method used in this legal research is the method of sociological juridical approach, meaning that a study conducted on real conditions in the community or community environment with the intent and purpose of finding facts, which then leads to identification and ultimately leads to problem solving. Sources of data in this study are primary data and secondary data. Data collection techniques are interview, study documentation, literature study. From this research, it can be seen that the responsibility of the insurance company as the guarantor of the insured who has a motor vehicle accident that is detrimental to the third party, the insurance company will compensate the insured caused by the motor vehicle guaranteed to be in accordance with the maximum insurance price and will be reduced by own risk costs. In accordance with what is stipulated in Law No 40 Year 2014 article 1 section a. Regarding the process of settlement of the insured which is detrimental to the third party due to a motor vehicle accident the insurance company will compensate by paying the claim submitted by the insured who is in accordance with the procedures determined by PT. Asuransi Bintang Malang City, that the compensation is in the form of repairs repaired, as well as replacement of parts or vehicles according to the same brand, type, model and year according to the contents of the policy. And make vehicle repairs to third parties who are harmed by the insured in accordance with the price of the responsibility of the third party's responsibility (TJH III) provided by the insurance company
