PENGAWASAN PENYIDIKAN TINDAK PIDANA DALAM MENCEGAH TERJADIANYA PENYIMPANGAN ATAU PELANGGARAN HAK TERSANGKA GUNA MEWUJUDKAN KEPASTIAN HUKUM HAK TERSANGKA DALAM PROSES PENYIDIKAN (STUDI DI POLRES MALANG KOTA)

In criminal justice in Indonesia, The role of the investigator is an important part of finding evidence that someone is committing a criminal act. However, the investigation frequently violates the suspect's rights as it is stipulated in the provisions of the Criminal Code (KUHAP). This research was the supervision of criminal offenses in preventing the occurrence of irregularities or violations toward the suspects' rights in the investigation process at Malang Police City Resort. The research aimed to determine and assess the effectiveness of the supervision of criminal investigations in the police resort. The method of the research applied the sociological juridical approach that is analyzing and assessing the process of law in society by referring to the provisions of the police chief regulation number 14 of 2012, a regulation that manage criminal investigations. Based on the results of this research, it showed that the surveillance process at the police city resort did not run optimally which is influenced by several factors; 1) low human resource factors, 2) sanctions that have not provided deterrent effects and 3) the scope of work is limited in the supervision of investigative regulations. Several suggestions such as increasing the number of surveillance investigations, improve the integrity of law enforcement, and provide strict sanctions for investigators who violate are needed
