Mekanisme Pengadaan Tanah Untuk Pembangunan Jalan Lingkar Selatan Kota Batu Dalam Perspektif Keadilan dan Kesejahteraan

This study aims to determine the procedures for planning, preparation, implementation and submission of result in land acqusition for the construction of the southern ring road in the city of Batu, to find out what are the obstacles of the city goverment of Batu or land acquisition providers related to settlement of compensation in land acquisition for the construction of the southern ring road in the city of Batu and knowing the award of compensation to those who have the right in the perpective of justice and welfare. The research method in this study is empirical juridical which in other words is a type of sociological juridical legal research and can be referred to as field research. The research location chosen by the author was at the Batu City Government Office and the Junrejo sub-district of Batu City, which was the location of land acquisition for the construction project of the Batu City through road. The data collection technique uses interviews, documentation and the internet, while the data analysis technique uses qualitative descriptive analysis. The results of the study show that 1) the mechanism for land acquisition consists of the planning, preparation, implementation and delivery of results in accordance with Law Number 2 of 2012 concerning Land Procurement for Public Interest Development, 2) related to the constraints of Batu City Government or procurement providers land in the construction of land for translucent roads, namely at the time of deliberation in determining land prices, where the community is sometimes still not aware that land acquisition for public interests is not like land acquisition carried out by the private sector or investors so that the price request sometimes exceeds the price set by the appraisal assessment team made it difficult to reach an agreement as three building land owners who were on Jalan Raya Dadaprejo from 2015 requested a compensation value of 9 million per square meter, but because the price was too high for the government, deal it can't happen in 2017 at 8,5 million
