Analysis of the legislative individualization of the penalty in the criminal code in the light of the principle of proportionality and the judicial power to enforce justice in the application of the penalty with the use of alternative law

The purpose of this monograph is to study the proportionality of crimes established in the Criminal Code, showing their disparities when comparing crimes with others, based on this comparison in the severity and consequences of the crime. It will also be analyzed the possibility of the magistrate at the time of application of the penalty to act more fairly, using mechanisms or currents that aim to apply a more beneficial penalty, adjusting it in each case. The research will be in the exploratory modality, regarding the approach will be qualitative, as far as the procedure of collection of damages, will be bibliographic and documentary. The work will examine, based on the principle of proportionality, the quantum of punishment of some crimes of the Penal Code, mainly crimes of Title II of the Special Part of this code, in view of the patrimonialist current used by the legislators when the Brazilian Penal Code . In this way, the magistrate can use the Alternative Law to apply a fairer penalty to the accused, a measure that must be used until the creation of a criminal law.A presente monografia tem como desígnio o estudo da proporcionalidade dos crimes estabelecidos no Código Penal, demonstrando suas disparidades se compararmos uns crimes com os outros, embasando esta comparação na gravidade e consequências do delito. Far-se-á também a análise da possibilidade de o magistrado no momento de aplicação da pena agir de forma mais justa, utilizando-se de mecanismos ou correntes que visam a aplicar uma pena mais benéfica, adequando-a em cada caso concreto. A pesquisa será na modalidade exploratória, no tocante à abordagem será qualitativa, no que concerne ao procedimento de coleta de dados, será bibliográfico e documental. O trabalho examinará, com base no princípio da proporcionalidade o quantum de pena de alguns crimes do Código Penal, principalmente os crimes do Título II da Parte Especial deste código, tendo em vista a corrente patrimonialista utilizada pelos legisladores no momento da confecção do Código Penal Brasileiro. Desta forma, poderá o magistrado utilizar-se do Direito Alternativo para aplicar uma pena mais justa ao acusado, medida esta que deve ser utilizada enquanto não ocorrer a confecção de uma lei penal
