Application of mediation as restorative justice with adolescents in conflict with law

This article deals with the use of mediation as a form of restorative justice for adolescents in conflict with the law, addressing the theoretical methodological aspects that distinguish restorative justice from retributive justice. The goal is to demonstrate the applicability of mediation practice, highlighting it as an instrument of restorative justice and as a new reference in the treatment of conflicts with adolescents. Believing, therefore, that if the culture of conflict resolution through dialogue is publicized and instigated, there will be greater acceptance by the people involved in the infraction, thus restorative justice as an alternative in the resolution of conflicts and interests, and in this way, a culture of peace and of relationships, both family and social, can be established. Therefore, mediation is a form of restorative justice with adolescents in conflict with the law, which aims to give an effective end to the conflict, emotional and legal, seeking the causes that generated the act, for due referral for the parties to be able to detect the reason which led the teenager to commit the act, and thus, can find the solution more favorable, without being harmed and with the respective reintegration social and family life.O presente artigo versa sobre a utilização da mediação como forma de justiça restaurativa para adolescentes em conflito com a lei, abordando, os aspectos teóricos metodológicos que diferenciam a justiça restaurativa da justiça retributiva. O objetivo é demonstrar a aplicabilidade da prática da mediação, destacando-a como instrumento de justiça restaurativa e como uma nova referência no tratamento de conflitos com os adolescentes. Acreditando-se, assim, que se a cultura de resolução de conflitos por meio do diálogo, for divulgada e instigada, haverá uma aceitação maior por parte das pessoas envolvidas no ato infracional, tendo assim, a justiça restaurativa como uma alternativa na resolução de conflitos e interesses, podendo desta maneira, estabelecer-se a cultura da paz e dos vínculos de relações, tanto familiares quanto sociais. Portanto, a mediação é uma forma de justiça restaurativa com adolescentes em conflito com a lei, a qual visa dar fim efetivo ao conflito, emocional e jurídico, buscando as causas que geraram o ato, para o devido encaminhamento para as partes conseguirem detectar a razão que levou o adolescente a cometer o ato, e assim, possam achar a solução mais favorável, sem serem lesadas e com a respectiva reintegração social e familiar
