Análise dos fundamentos utilizados pelo supremo tribunal federal que levaram ao entendimento pela ilegalidade da prática do homeschooling

The purpose of this monography is to present and analyze the grounds used by the Federal Supreme Court, which concluded that the practice of home education as a teaching modality is illegal, discussing the Extraordinary Appeal nº. 888,815 / RS. Homeschooling is the practice adopted by parents or guardians of children and adolescents to promote home-based education. In order to reach the proposed objective, the exploratory research was used, and for the collection of data, the research of the bibliographic and documentary types was used. An analysis was made of the evolution of education in Brazil, as well as the main principles related to the subject, in order to analyze the country's existing norms related to education, and even the existence of bills that intend to include the practice of home teaching in the legal order. There are those who argue that parents have a right of choice in their children's education, however, there is no legislation regulating the exercise of this right. On the other hand, the Law of Directives and Bases of Home Education, Law nº. 9,394 / 1996, and the Statute of the Child and Adolescent, Law nº. 8,069 / 1990, impose compulsory enrollment in a school institution. Many families have opted for homeschooling, requesting authorization from the Judiciary so that they can exercise this modality of teaching. The Brazilian Supreme Court was prompted to express its views on the matter in the Extraordinary Appeal nº. 888.815/RS, and after analyzing numerous grounds, concluded that such practice is not unconstitutional in the Brazilian legal system, however, it appears to be illegitimate.O presente trabalho tem como objetivo apresentar e analisar os fundamentos utilizados pelo Supremo Tribunal Federal que concluiu pela ilegalidade da prática da educação domiciliar como modalidade de ensino, discorrendo acerca do Recurso Extraordinário nº. 888.815/RS. O homeschooling é a prática adotada pelos pais ou responsáveis de crianças e adolescentes de promover a educação em ambiente domiciliar. Para o alcance do objetivo proposto, utilizou-se a pesquisa exploratória e, para a coleta de dados, se utilizou a pesquisa dos tipos bibliográfica e documental. Fez-se uma abordagem da evolução da educação no Brasil, bem como elencou-se os principais princípios relativos ao tema, para, então, analisar as normas pátrias existentes no Brasil relacionadas à educação, e, inclusive, a existência de projetos de lei que pretendem incluir a prática do ensino domiciliar na ordem jurídica. Há quem defenda que os pais têm prioridade de direito na escolha sobre a educação dos filhos, no entanto, não há legislação que regulamente o exercício desse direito. Por outro lado, a Lei de Diretrizes e Bases da Educação Domiciliar, Lei nº. 9.394/1996, e o Estatuto da Criança e do Adolescente, Lei nº. 8.069/1990, impõem a obrigatoriedade da matrícula em uma instituição escolar. Muitas famílias tem optado pelo homeschooling, pleiteando autorização do Poder Judiciário para que possam exercer essa modalidade de ensino. A Suprema Corte Brasileira foi provocada a se manifestar sobre o tema nos autos de Recurso Extraordinário nº. 888.815/RS, e, após a análise de inúmeros fundamentos, concluiu que tal prática não é inconstitucional no ordenamento jurídico brasileiro, contudo, mostra-se ilegítima
