Relacionamentos poliafetivos e suas consequências jurídicas no âmbito sucessório

The purpose of this monographic work is to identify the legal consequences of polyphonic relationships in the field of succession. Regarding the method of approach, the research is characterized as qualitative, since it analyzes the principles, understandings of the courts, as well as doctrines linked to the proposed theme, starting from the general scope to the specific one. When, at the level, the nature of the research is classified as exploratory and with regard to the procedure of data collection, the research was carried out by the bibliographic criteria. At first, we try to present the evolution of the family entity, as well as the principles applicable in Family Law. In the same chapter, it is still about polyamory, conceptualizing and presenting its models. Following is the historical evolution of the successions, the hereditary vocations and the forms of inheritance existing in the Brazilian order. Finally, we analyze the legal validity of the polyamory and the application of inheritance law in polyphonic relationships. In view of the study carried out, it can be seen that poly-affective relations, although not expressly provided for in Brazilian legislation, were established in family law due to the changes that the family environment suffered over time, especially after the proclamation of the Federal Constitution of 1988. It is concluded, with the study carried out, that polyphonic relationships are part of the Brazilian legal system, seeking recognition and legislative protection.O presente trabalho monográfico tem como propósito identificar quais as consequências jurídicas dos relacionamentos poliafetivos no âmbito sucessório. No que se refere ao método de abordagem, a pesquisa caracteriza-se como qualitativa, visto que analisa os princípios, entendimentos dos tribunais, além de doutrinas vinculadas ao tema proposto, partindo-se do âmbito geral para o específico. Quanto ao nível, a natureza da pesquisa classifica-se como exploratória e no que se refere ao procedimento de coleta de dados, a pesquisa foi realizada pelo critério bibliográfico. A princípio, busca-se apresentar a evolução da entidade familiar, assim como, os princípios aplicáveis no Direito de Família. No mesmo capítulo, ainda, trata-se sobre o poliamor, conceituando e apresentando seus modelos. Em seguida, apresenta-se a evolução histórica das sucessões, as vocações hereditárias e as formas de sucessões existentes no ordenamento brasileiro. Por último, analisa-se a validade jurídica do poliamor e a aplicação do direito sucessório nos relacionamentos poliafetivos. Diante do estudo efetuado, verifica-se que as relações poliafetivas, apesar de não estarem previstas expressamente na legislação brasileira, se estabeleceu no direito de família devido as mudanças que o meio familiar sofreu ao longo do tempo, principalmente após a proclamação da Constituição Federal de 1988. Conclui-se, com o estudo realizado, que os relacionamentos poliafetivos fazem parte do ordenamento jurídico brasileiro, buscando reconhecimento e proteção legislativa
