Impasses sobre a licitude do ensino domiciliar, ministrado pela família, no ambiente familiar

In Brazil the modality of home teaching, given by the family, in the family environment, is still novel, although it is authorized in at least sixty countries in the world. A few Brazilian families show interest in the modality and, because of legal controversies about the subject, they resort to the Judiciary to carry out their practice. The problematic of the present monographic study involves the analysis of the concepts, principles and definition of home teaching, taught by the family, in the family environment, questioning whether it is possible to use the home teaching modality as a legal means of formal education in the current legal system Brazilian. In the north, studies have been undertaken in order to substantiate their regulation and application, while the bills, also referred to in this study, are processed in the National Congress, since, although currently few families are interested and seeking this authorization, in the long term there is the possibility that this number will increase and the prior knowledge about the pros and cons of the modality will be of great relevance. Thus, this monographic study may serve as a guide for researchers, not only lawyers, psychologists, psychologists, and so on. For the development of this work, it is pertinent to mention that the research, regarding the level or objectives, is exploratory, as far as the approach is qualitative. Algumas poucas famílias brasileiras demonstram interesse pela modalidade e, por isso, em razão das controvérsias jurídicas acerca do tema, recorrem ao Poder Judiciário para realizar a sua prática. A problemática que enseja o presente estudo monográfico envolve a análise dos conceitos, princípios e definição do ensino domiciliar, ministrado pela família, no ambiente familiar, questionando se é possível a utilização da modalidade do ensino domiciliar como meio lícito de educação formal no atual ordenamento jurídico brasileiro. Neste norte, foram empreendidos estudos com vistas a fundamentar a sua regulamentação e aplicação, enquanto os projetos de lei, também referidos neste estudo, tramitam no Congresso Nacional, uma vez que, muito embora atualmente sejam poucas as famílias interessadas e que buscam essa autorização, em longo prazo há a possibilidade de esse número crescer e o conhecimento prévio acerca dos prós e contras da modalidade será de grande relevância. Assim, esse estudo monográfico poderá servir de norte para, além dos operadores do direito, aos pesquisadores de pedagogia, psicologia, psicopedagogia e tantos outros. Para o desenvolvimento deste trabalho, pertinente mencionar que a pesquisa, quanto ao nível ou objetivos, é exploratória, no tocante à abordagem é qualitativa.
