Justiça restaurativa e sua aplicabilidade diante do Estatuto da Criança e do Adolescente

The present study aims to analyze, through the Statute of the Child and Adolescent, the risk factors and vulnerability conditions that minors are subjected to, from the time of the empire to the present, with an analysis of the juvenile offender's incapacity, socio-educational measures and restorative justice. This time, a study will be carried out on the problematic of the juvenile delinquency, since the beginning of crime, the applicability of legislation under the Restorative Justice as a form of conflict prevention, in view of the possibility of settling crime and allowing existence solutions. As a theoretical reference, it is based on Howard Zehr, on the possibility of establishing restorative justice. In this context, the Restorative Justice approach is used as an alternative to resolve conflicts characterized as crimes, in order to seek agreement between the victim and the offender in crimes of small and medium offensive potential.O presente trabalho tem como objetivo analisar através do Estatuto da Criança e do Adolescente, os fatores de risco e condições de vulnerabilidade que os menores são submetidos, desde a época do império até atualmente, com análise da inimputabilidade do menor infrator, as medidas socioeducativas e a justiça restaurativa. Desta feita, será realizado um estudo sobre a problemática da inimputabilidade do menor infrator, desde o início da criminalidade, a aplicabilidade da legislação sob o viés da Justiça Restaurativa como forma de prevenção de conflitos, diante da possibilidade de dirimir a criminalidade e possibilitar a existência de soluções. Como referencial teórico se pauta em Howard Zehr, quanto à possibilidade de instaurar a justiça restaurativa. Neste contexto, a abordagem da Justiça Restaurativa se pauta como alternativa para resolução de conflitos caracterizados como crimes, para a busca de acordo entre a vítima e o infrator nos crimes de pequeno e médio potencial ofensivo
