Atividades passíveis de terceirização na iniciativa privada à luz da lei n. 13.429/2017 e lei n. 13.467/2017

ABSTRACT This monograph aims to analyze the activities that can be outsourced in the private sector after Law 13.429/2017 and Law 13.467/2017. The method of approach used for the elaboration of this study is the qualitative research and the exploratory level. As for the data collection procedure, it is classified as bibliographical and documentary, performed through the technique of textual recording. The present work seeks to define which activities can be outsourced in private initiative after Laws 13.429/2017 and 13.467/2017, resulting in uncertainty as to what should be applied, given that the Attorney General's Office entered with a Direct Action of Unconstitutionality to clarify the unconstitutionality of the law with respect to the possibility of unrestricted outsourcing, so that to affirm with vehemence it is necessary to await the judgment of the action. It can be concluded that even without a certain definition of what is right or not, the doctrine is against the permitting of outsourcing in the final activity, as well as the Office of the Attorney General of so it is important that this direct action of unconstitutionality be judged so that outsourcing in the final activity is prohibited and declared unconstitutional.RESUMO Esta monografia tem por objetivo analisar as atividades passíveis de terceirização na iniciativa privada após a Lei n. 13.429/2017 e a Lei nº 13.467/2017. O método de abordagem utilizado para a elaboração deste estudo é a pesquisa qualitativa e quanto ao nível exploratória. Quanto ao procedimento de coleta de dados classifica-se como bibliográfica e documental realizado através da técnica de fichamento textual. O presente trabalho busca definir quais as atividades são passíveis de terceirização na iniciativa privada após as Leis nº 13.429/2017 e 13.467/2017, tendo como resultado uma incerteza sobre o que realmente se deve aplicar, tendo em vista que a Procuradoria-Geral da República entrou com uma Ação Direta de Inconstitucionalidade para declarar a inconstitucionalidade da lei no que diz respeito à possibilidade de terceirização irrestrita, de modo que para afirmar com veemência é preciso esperar o julgamento da ação. Pode-se concluir, que mesmo sem uma definição do que é certo ou não, a parcela da doutrina é contra a permissão da terceirização na atividade-fim, assim como o Procuradoria-Geral da República, de modo que é importante que essa ação direta de inconstitucionalidade seja julgada para que a terceirização na atividade-fim seja proibida e declarada inconstitucional
