Profile of physicians judged in ethical-professional processes in Santa Catarina, 2010 to 2016

All of the technological advancement of medicine must be accompanied by the growth and appreciation of the human being that exists in each physician and patient. It is included in the civil contract of the physician with the patient both the responsibility and the obligation of means, for which the physician must dedicate fully his diligence, competence and prudence without commitment of results or ends. When there is a disregard of these precepts, the physician may get involved in ethical infractions. Establishing a good relationship with patients and their families, can propitiate more personal relationships, thus avoiding lawsuits and legal conflicts, especially those that may be avoidable. Medical education is the basis for expanding discussions on issues related to the medical act and to the profession’s regulations. This is a way of stimulating reflection on ethical values, adequate professional conduct, but also on the humanistic and communication skills of professionals and future doctors. This said, the present research aimed to recognize the profile of the doctor processed in Santa Catarina, from 2010 to 2016, and the main factors associated with the outcomes under analysis. This is a cross-sectional observational study and it was carried out in CREMESC. It was sought to contemplate the demographic characteristics, those related to the medical training, the profile of the complaint and the procedural acts. Bivariate analysis was performed in a categorical form, using the Chi-square Test or Fisher's Exact Test – pre-established significance level of 5% (p≤0.05). The measure of association used was Prevalence Ratio (PR), with Confidence Intervals of 95%. The profile of doctors processed by “CREMESC”, between 2010 and 2016, was predominantly characterized by those being male, with approximately 50 years old, and 23 from graduation, that were coursed in a free Higher Education Institution (HEI), in Rio Grande do Sul, and specialized in General Surgery. The denunciations were made by ex officio form, due to events occurred in hospitals, and they were condemned and sentenced in Confidential Censorship in Reserved Notice, for violating Article 18 of the “CEM”, not being recidivists. We believe that prevention is the most appropriate way to avoid mistakes, and continued medical education is one of the pillars of human academic education.Todo o avanço tecnológico da medicina deve ser acompanhado do crescimento e da valorização do ser humano existente em cada médico e em cada paciente. Insere-se no contrato civil do médico com o paciente a responsabilidade e a obrigação de meios, para os quais deve o profissional dedicar integralmente sua diligência, competência e prudência, sem haver o compromisso de resultados ou fins. Quando há a inobservância destes preceitos, pode o médico incidir em infrações éticas. Estabelecer uma boa relação com o paciente e seus familiares, pode propiciar relacionamentos mais pessoais, evitando, assim, demandas judiciais e conflitos legais, especialmente aqueles possivelmente evitáveis. Tem-se na educação médica a base para ampliar discussões sobre temas relacionados ao ato médico e às regulamentações da profissão. Dessa forma se objetiva estimular a reflexão sobre os valores éticos, condutas profissionais adequadas, mas também, sobre as habilidades humanistas e de comunicação dos profissionais e futuros médicos. Diante disso, a presente pesquisa objetivou reconhecer o perfil do médico processado em Santa Catarina, de 2010 a 2016, e dos principais fatores associados aos desfechos em análise. O estudo é do tipo observacional transversal e foi realizado no Conselho Regional de Medicina de Santa Catarina (CREMESC). Buscou-se contemplar as características demográficas, as relacionadas à formação médica, ao perfil da denúncia e aos atos processuais. A análise bivariada foi realizada de forma categórica, com auxílio do Teste do Qui-quadrado ou Prova Exata de Fisher – nível de significância preestabelecido de 5% (p≤0,05). A medida de associação utilizada foi Razão de Prevalência (RP), com Intervalos de Confiança de 95%. O perfil de médicos processados pelo CREMESC, entre 2010 e 2016, se caracterizou por ser este médico sexo masculino, com aproximadamente 50 anos e 23 de formação, graduado em Instituição de Ensino Superior (IES) gratuita, no Rio Grande do Sul, especializado em Cirurgia Geral. Foi denunciado de forma ex officio, por fatos ocorridos em hospitais, sendo condenados e apenados em Censura Confidencial em Aviso Reservado por infração ao Artigo 18 do Código de Ética Médica (CEM), não sendo reincidente. Acreditamos que a prevenção seja o caminho mais adequado para se evitar erros, sendo a educação médica continuada um dos pilares essenciais na formação humana
