Homeschooling in the front of brazilian legislation: an analysis of the country's duty-duty concerning the education of children

This monographic study presents a study on home education in front of the Brazilian legislation, pondering the power-of-duty of the parents regarding the education of the children. To disentangle the theme, it was adopted as a general objective to analyze if the home schooling (Homeschooling) has protection under the Brazilian legislation and therefore the parents' power-of-duty in what concerns the education of the children. In the development of the theme, the adopted procedure was a bibliographical research, of deductive method and exploratory level. As a conclusion, it was defined that regarding domestic education there is no prohibition or regulation in Brazil, only that the Federal Constitution requires parents to educate their children. For this purpose, the principle of legality, provided for in the Charter, is also applicable to the case, and it is also stressed that the Universal Declaration of Human Rights guarantees that parents have the right of choice in the education of their children.Este trabalho monográfico apresenta um estudo sobre a educação domiciliar frente a legislação brasileira, ponderando sobre o poder-dever dos pais quanto a educação dos filhos. Para destrinchar o tema, adotou-se como objetivo geral analisar se instituto do ensino domiciliar (Homeschooling) tem amparo dentro da legislação brasileira e por conseguinte o poder-dever dos pais no que concerne a educação dos filhos. No desenvolvimento do tema, o procedimento adotado foi uma pesquisa bibliográfica, de método dedutivo e nível exploratório. Como conclusão, definiu-se que quanto à educação domiciliar não existe na legislação brasileira proibição nem regulamentação deste, apenas que a Constituição Federal exige dos pais o dever de educar seus filhos. Para tanto aplica-se ao caso o princípio da legalidade, previsto na Carta Magna, ressaltando, ainda, que é garantido pela Declaração Universal dos Direitos Humanos que os pais possuem prioridade de direito de escolha na forma de instrução dos filhos
