Terceirização como meio de flexibilização ou precarização: um estudo sobre a lei 13.429 DE 2017 e seus impactos sobre as relações de trabalho no Brasil

The purpose of this study is the effects of Law n.13.429 of March 31, 2017 brings to the legal order with its content that legalizes the outsourcing in wide scope. To do so, it begins with a contextualization in the working world since the introduction of the capitalist system, observing all historical evolution of the workers in the world and in Brazil, in order to present insertion of outsourcing at work. Next, one studies in the terminology and the concept of outsourcing. It is also analyzed every process of PL n. 4.302, a bill that gave rise to the law studied here. It is also examined the new wording of law in the light of the Brazilian Democratic State of Law, mentioning the principles and devices rooted in the Constitution and in the juristrabalista field. We also investigate all the changes that Law no. 13.429 provoked in the norms that order the labor law, also the consequences that it brought in the work of the syndicates, as well as the conceptions and understandings that the specialized justice in the work is assigning. The paper ends with a critical perspective on the new rule, taking a look at the consequences and effects that it retains, concluding that the impacts of flexibilizing the rigor of labor standards with the help of outsourcing on a large scale has resulted in the precariousness of the who will retract his rights to maintain a heated economic market. The methodological criteria adopted in this work are based on the bibliographic method, also using immediate legal-formal research sources such as laws and jurisprudence.O presente estudo monográfico tem por objetivo a análise dos efeitos da Lei n.13.429 de 31 de março de 2017 sobre as relações de trabalho no Brasil, pois com seu conteúdo institucionaliza a terceirização em ampla abrangência. Para tanto, inicia-se com uma contextualização das relações de trabalho, observando toda evolução histórica dos obreiros no mundo e no Brasil, para assim apresentar a terceirização no trabalho. Em seguida, estuda-se o conceito de terceirização, analisa-se, também, todo o tramite da PL n. 4.302, projeto de lei no qual deu origem a lei ora estudada, examina-se, ainda, a nova redação da lei da terceirização a luz do Estado Democrático de Direito Brasileiro, mencionando alguns princípios e dispositivos enraizados na Constituição e no campo juristrabalhista. Pesquisa-se, ainda, as alterações que a Lei n. 13.429/2017 provoca nos normativos que ordenam o direito do trabalho, também as consequências na atuação dos sindicados, assim como as concepções e entendimentos da justiça especializada no trabalho. Encerra-se o este estudo monográfico, abordando uma perspectiva a crítica sobre a nova regra, passando para um olhar sobre as consequências e efeitos que ela produzirá, no sentido da flexibilização ou da precarização das relações de trabalho no Brasil. Os procedimentos metodológicos adotados neste estudo monográfico tem como referência a pesquisa bibliográfica, também utilizando-se de fontes imediatas jurídico-formais como leis e jurisprudências
