A (im)possibilidade de destituição do poder familiar nos casos de doença mental dos pais

This paper aims to analyze if the removal of family power is a reasonable measure to be applied in cases of parents with mental illness. The method used is deductive. The procedure is monographic. The approach is qualitative. As for the objectives, the research is exploratory. The technical procedure is the bibliographical one, being used as research source doctrines, legislation, articles and national jurisprudences pertinent to the subject in question. Throughout the work, it has been observed that few institutes have been as important throughout history as family power, since it underwent several transformations, from the time the term "mother power" was used until the current "family power" , considered a power-duty of protection to the children. Therefore, there are cases in which this family power may be extinguished, suspended or dismissed. The paper analyzes the destitution, which occurs when the conduct of the parents in relation to the minor children is shown in a devious way. The results indicate that the understanding in the Courts of Justice regarding the recognition of the destitution of family power as a result of the mental illness of the parents is growing, which can cause emotional harm to children and adolescents, since it opposes all legislation relevant to protection integral and to their best interest and well-being, since they are withdrawn from the already existing family nucleus. Thus, it is concluded that the removal of family power may not be viable in relation to the parents with mental illness, since it is not in accordance with the law, being a drastic measure, and in these specific cases the State does not prioritizes the minor and the family, since these parents need protection and assistance from the State, as provided by law.Este trabalho tem por objetivo geral analisar se a destituição do poder familiar é medida razoável a ser aplicada nos casos de pais portadores de doença mental. O método utilizado é o dedutivo. O procedimento é o monográfico. A abordagem é qualitativa. Quanto aos objetivos, a pesquisa é do tipo exploratória. O procedimento técnico é o bibliográfico, utilizando-se como fonte de pesquisa doutrinas, legislação, artigos e jurisprudências nacionais pertinentes ao tema em questão. Ao longo do trabalho, observou-se que poucos institutos têm sido tão importantes ao longo da história quanto o do poder familiar, pois este passou por várias transformações, desde a época era utilizada a expressão “pátrio poder” até o atual “poder familiar”, considerado um poder-dever de proteção aos filhos. Portanto, há casos em que esse poder familiar poderá ser extinto, suspenso ou destituído. O trabalho analisa a destituição que ocorre quando a conduta dos pais, em relação aos filhos menores, é mostrada de maneira desidiosa. Os resultados indicam que é crescente o entendimento nos Tribunais de Justiça quanto ao reconhecimento da destituição do poder familiar em decorrência da doença mental dos pais, o que pode causar prejuízos emocionais às crianças e aos adolescentes, tendo em vista que contrapõe toda legislação pertinente à proteção integral e ao seu melhor interesse e bem-estar, pois são retiradas do núcleo familiar já existente. Desta forma, conclui-se que a destituição do poder familiar pode não ser viável em relação aos pais portadores de doença mental, pois não está em conformidade com a lei, tratando-se de uma medida drástica, sendo que, nesses casos específicos, o Estado não prioriza o menor e o âmbito familiar, pois estes pais necessitam de proteção e assistência do Estado, como previsto na legislação
