Legislação trabalhista no meio aeronáutico: direitos e deveres dos empregadores brasileiros e de seus tripulantes

The present monograph aims, in essence, to examine the aviation labor legislation concerning the legal relationship developed between the crew member and the employer. In this regard, the analysis begins with a brief historical overview of Labor Law. The methods of legal interpretation are subsequently examined, in a pragmatic approach, with the intention of bringing awareness to the crew as well as their respective employers, on what concerns to their duties and obligations referring to the employment relation. Considering these premises, the pertinent labor legislation regarding to the employment relationship between the crew member and the employer is scrutinized, in order to demonstrate the range of regulations contained in the Consolidation of Labor Laws which are applicable to aviation environment. Finally, the consequences of noncompliance with the labor legislation, both by the employee and his employer, are reviewed. It is intended to develop the work based on practical terms, which will enable the technical-legal knowledge democratization, especially to ensure the aviation category welfare. As a conclusion to the dissertation, the rights to be pursued concerning labor legislation are reviewed, and, on the other hand, which ones are contained in the respective aviation laws as well.A presente monografia objetiva, precipuamente, examinar a legislação trabalhista aeronáutica na relação jurídica desenvolvida entre o tripulante e o empregador. Para isso, inicia-se a análise com um breve escorço histórico sobre o direito do trabalho. Em seguida, examinam-se os métodos de interpretação jurídica, de forma pragmática, com o intuito de trazer ao conhecimento dos tripulantes e seus respectivos empregadores, seus deveres e obrigações na referida relação empregatícia. Com essas premissas, passa-se a esmiuçar a legislação trabalhista pertinente à relação empregatícia desenvolvida entre o tripulante e o empregador, com o fim de demonstrar a gama de normas constantes na Consolidação das Leis Trabalhistas aplicáveis ao meio aeronáutico. Finalmente, verificam-se as consequências do descumprimento da legislação trabalhista, tanto por parte do empregado, quanto do seu empregador. Pretende-se desenvolver um trabalho pautado em termos práticos, que viabilize a democratização do conhecimento técnico-jurídico, sobretudo para garantia do bem-estar da classe aeronáutica. Conclui-se o trabalho enfatizando a importância do cumprimento da legislação trabalhista aeronáutica por todos os envolvidos neste meio, mitigando os riscos e administrando-os à níveis aceitáveis conciliando segurança com produtividade e lucratividade dentro de uma empresa aérea
