Whether the main subject in evaluating the proportionality of the European arrest warrant should be the state issuing it?

Siekiant atsakyti į iškeltą klausimą, analizuojamas Europos arešto orderio proporcingumo principas, jo vertinimas bei svarba, nagrinėjama kada yra laikomas tokios priemonės netinkamas įvertinimas ir vykdymas.This thesis intends to reveal whether the main subject in evaluating the proportionality of the European Arrest Warrant should only be the state issuing it. In order to answer the posed question, the principle of proportionality of the European Arrest Warrant, its evaluation and importance are analysed. The present paper also studies cases when evaluation and execution of the European Arrest Warrant are considered to be ineligible. It is important to examine and show what the obligation of the Member States is, when the criminal principle, human rights and freedoms are violated.
