Fundamentos do Direito à Igualdade na Aplicação da Lei

The article analyses the grounds of the right to equality upon application of law in Brazilian legal system. It examines the conceptions of H. Kelsen and R. Dworkin about the interpretation and application of law and the transformations of the right to equality in the welfare state. It investigates the normative content of the right to equality under the Constitution of 1988, with focus on the right to non-discrimination, and proposes that the right to equality upon application of law is composed by two dimensions: a right to equal treatment and a right to different treatment.O artigo analisa os fundamentos do direito à igualdade na aplicação da lei no ordenamento jurídico brasileiro. Examina as concepções de H. Kelsen e R. Dworkin sobre intepretação e aplicação do direito e as transformações do direito à igualdade no Estado Social de Direito. Investiga o conteúdo normativo do direito à igualdade sob a Constituição de 1988, com ênfase no direito à não discriminação, e propõe que o direito à igualdade na aplicação da lei está composto por duas dimensões: direito a um tratamento igual e direito a um tratamento diferente.
