PENEGAKAN HUKUM DALAM TINDAK PIDANA PENIPUAN MELALUI MEDIA ELEKTRONIK (Studi Kasus di Polres Malang Kota)

The development of crime through electronic media and or using electronic media facilities is growing rapidly, especially electronic fraud in the past few years has become a serious problem and quite alarming for the people of Indonesia. The formulation of the problem in this study is related to law enforcement through electronic media in Malang City Police. The purpose of writing is to find out and study how the enforcement of the law and the inhibiting factors of the enforcement. This research method uses the method of sociological juridical approach that is seeing the implementation of the law relating to fraud in the community carried out by data collection techniques through interviews and observations at Malang City Police. The types of data used are primary data and secondary data. Analysis using qualitative descriptive analysis. Based on the results of research related to law enforcement fraud through electronics media has been carried out in accordance eith procedures by Malang City Police through prevention and enforcement measures. The inhibiting factors are difficulty in getting information and detecting perpetrators, evidence is easily removed, deleted, damaged, investigation can be interrupted by the system or delayed by a system that is stuck. The conlusion is that law enforcement has been carried out by Malang City Police in accordance with procedurs in accordance with the legal certainty stipulated in the criminal code and other laws even through there are still obstacles related to inadequate thechnological systems in the police. The Advice of the goverment, the community and the police should be to actively collaborate in tackling online fraud crime, and educate and train police personnel in advanced information technology
