Criminal liability for causing physical pain or negligible bodily harm

High rate of crimes against human’s health, makes analysis of criminal liability for causing physical pain or negligible bodily harm, relevant on both, theoretical and practical levels. The Master thesis focus is on the analysis of the criminal liability for one of violent acts against health – causing physical pain or negligible bodily harm. Article 140 of the Criminal Code of the Republic of Lithuania establishes liability for beating or other violent acts, which cause a person physical pain, negligible bodily harm or a short-term illness. For the presentation of the conception of criminal liability, the definitions of the criminal liability given in the literature of law have been investigated, the basics of prosecution have been discussed. The Master thesis presents the detailed analysis of the structure of causing physical pain or the negligible bodily harm, measures of criminal liability for this act, and the main problems of applying provisions of Article 140 of the Criminal Code. Attention has been payed to the qualifying feature – causing physical pain or negligible bodily harm to a close relative or family member – as a differentiating people’s health. Moreover, the problem of violence against minors and the conception of torture have been discussed. The Master thesis also includes the analysis of the problem – whether physical pain and negligible bodily harm could be recognized as a minor crime or a constituent of other crimes.
