L’embryon en suspens

This article uses as its starting point a news item in which the principal protagonists disagree as to the way in which embryos frozen after an in vitro procedure should be disposed of after the death of the woman’s partner. The case is presented as a paradigm of assisted conception, emphasizing the radical transformation of the context in which parents, physicians and scientists are making decisions about embryos and bringing to light the redistribution of power and responsabilities among protagonists which this transformation implies. A comparison of the different elements of this case with the parameters established for decision-making in the French abortion law (1975) reveal the paramount importance of the physical location of the embryo (in or outside the woman’s body) in defining the situation and understanding the conflict.Cet article part d’un fait divers où les principaux protagonistes s’affrontent sur le sort à réserver à des embryons conçus in vitro et congelés, suite à la mort du conjoint de la femme traitée. Le cas est présenté comme paradigme de la procréation assistée. Il souligne la radicale transformation du contexte dans lequel parents, médecins et scientifiques ont à prendre des décisions sur des embryons et fait émerger la redistribution de pouvoir et de responsabilités entre protagonistes que cette transformation implique. Une comparaison des éléments de ce fait divers avec les paramètres de prise de décision établis dans la loi sur l’interruption de grossesse (1975) révèle l’importance déterminante, pour la définition de la situation et pour la compréhension du conflit, de la localisation physique de l’embryon (dans ou hors du corps de la femme).Bateman Simone, Salem Tania.
