Mediation has been, more or less recently, amended by statutory provisions in the various European states. However, national models, degree of details of Statutes and judicial practices differ on many points. The legal effect of a mediation clause varies according to states. The Lawyers’ duty to inform their client about ADR does not exist in all European jurisdictions, and if some states, such as Italy, more concerned with the caseload of their courts than with guaranteeing effective access to justice, have imposed preliminary mandatory mediation in many legal disputes, the majority of other jurisdictions regards mediation solely as a voluntary process.
