The age of nubility is fixed at eighteen in Moroccan family law. Wishing to put an end to early marriage often harmful to child’s physical and mental health, the law makes the marriage of a minor to a prior judicial authorization. The age exemption is only granted for specific reasons making the marriage necessary and exceptional. The judge should first conduct a medical examination or a social investigation to arbitrate in favor of the child’s interests. If the marriage of a minor is intended by law as a necessary exception in some cases, it must be justified by the interest of the child.
