The concept of disability is established by the Court of Justice of the European Union and has undergone successive changes. In the recent judgment of 18 December 2014, in the case Fagog Arbejde (FOA) v town in Billund (Denmark), the Court was, for the first time, invited to comment on the questions of whether there are provisions in EU law which would apply to discrimination in the labour and employment based on obesity and whether obesity can be considered as a disability.
