This study attempts to explain the jurisdictional function of the International Court of Justice within the structure of the international legal order. Even though the ICJ is the principal organ of the United Nations according to the Charter, it remains somewhat marginalized because of the absence of a mandatory jurisdictional competence, the caution it itself takes to determine the will of states to submit themselves to its jurisdiction, and the absence of a jurisdictional monopoly on international legal interpretation.
